I do believe this is a Hairy Woodpecker (male) however I think there is more than one bird here.
It would fly in and sit in the branches for the longest time before flying down to drink.

It didn't come to the fountain to drink but would stay on the out skirts of the area to drink from the over flow of water.

I ID'ed the bird by the black area under the eye. The Downy had a different shaped black patch.
