Eastern Kingbird
Approximately 8 to 9 inches in length normally perches very up right
on branches looking for a flying insect to fly out and grab.
It's orangeish/reddish crown patch is very seldom seen.

Doesn't look to up-right perched to me. If you will note this bird has a
yellow/greenish cast to its lower under parts (under tail coverts).
